This Privacy Policy is incorporated by reference into the Equilli Terms and Conditions.


The term “Equilli,” “our,” “we,” “us,” “Equilli community” includes Equilli, Inc. and our affiliates and subsidiaries. “You” and “users” shall mean all users of the Service. This Privacy Policy, together with any documents they expressly incorporate by reference, govern your access to and use of http://www.equilli.app/ (the “Website”), or our mobile application, Equilli (the “App”), including any content, functionality and services offered on or through the Website or the App (together with the Website and App, the “Service,” “Services”), whether as a guest or a registered user. To use our Services you must be 18 years of age or older. If you are under 18, you may not download or use the Services. Equilli will not be held liable for any user under the age of 18 who decides to violate this policy. Your use of the Services is subject to the Terms and Conditions and this Privacy Policy and indicates your consent to them.

This Privacy Policy is meant to help you understand what information we collect, why we collect it, and how you can update, manage, and delete your information. This Privacy Policy covers:


Equilli is an app-based communications platform which enables connections between Requesters and Providers. “Requesters” are individuals and/or businesses seeking to obtain short-term task services (“Tasks”) from Providers and are therefore clients of Providers, and “Providers” are individuals and/or businesses seeking to perform Tasks for Requesters. Requesters and Providers together are hereinafter referred to as “Users.”

Personal Information:

“Personal Information” means information that alone or when in combination with other information may be used to readily identify, contact, or locate you, such as: name, date of birth, address, email address, phone number, vehicle make, vehicle model, vehicle license plate, location or photographs. We do not consider Personal Information to include information that has been anonymized so that it does not allow a third party to easily identify a specific individual.

  1. User Accounts & Accessing the Services


Requesters and Providers:

You must register in order to request or provide a task through the Service. To register, you may need to provide Personal Information, such as your name, date of birth, phone number, email address, address, vehicle make, vehicle model, vehicle license plate or photographs. You may also provide other optional information.

Using the Service:

We collect information you post through the Service. For example, when you book or provide a task, the Service will collect the information you provide in such submissions, including any Personal Information. We will also store your task history.

Please note that when you install the App on your mobile device, Equilli will prompt you to set up an account associated with that mobile device (the “Account” or “Equilli Account”). This Account will be accessed by logging in using the Account username and password you create. After installation, Equilli will collect and use your information, including meta-data (as described below), in accordance with this Privacy Policy. This use may include linking your information with your Account.

Equilli may allow you to use the app whether or not you choose to set up an Account. If you choose to use the Equilli Services without setting up an Account you may do so by skipping the Account setup stage of the application installation process, however we still may collect any personal information and meta-data provided or accessible.

Your login details are your responsibility. You are fully accountable for any use or misuse of your Account and personal information as a result of conveying your login details to someone else. You must maintain your login details in absolute confidentiality and avoid disclosing them to others. Make sure that you change your password frequently and at least once every six months.


  1. Information that is Being Collected


Account Information:

Information required when setting up an Account, such as username and password you have created, your name and date of birth, phone number, email address, address, vehicle make, vehicle model, vehicle license plate or photographs.. Bear in mind that false, incorrect, or out-dated information may impair Equilli’s ability to provide you with the Services and to contact you when necessary. Equilli will explicitly indicate the fields for mandatory completion. If you do not enter the requisite data in these fields, you may not be able to set up an account.

Information that you choose to share with Equilli:

A username you have chosen, reports associated with your username, phone number, your “home” and “work” addresses and other “favorite” points of interest (if you choose to provide such information). Even if you aren’t signed in to an Equilli Account, you might choose to provide us with information - like an email address to receive updates about our services.

Communication which you choose to conduct through the Equilli Services:

If you choose to use Equilli to communicate with other Equilli users or third parties through the Equilli Services, such as chat messages or sending pinned locations on or off of the Equilli platform.

Detailed location, travel and route information:

Location and route information is collected for example in the form of GPS signals (combined with a time-stamp) and other information sent by your mobile device on which the App is installed and activated. This location and route information is saved to a task history of all of the tasks you have participated in while using the App. The types of location data we collect depends in part on your device and account settings. For example, depending on your selected device settings and/or your account settings we may collect information about your location and travel (or lack thereof) also while you are not using the app, in order to be able to tell you when to leave for planned tasks, analyze how effective our ads are and more;

Information You Provide About a Third Party:

If you use our referral program to tell a friend, relative or someone you know about our Service (a “Referred Person”), we will ask you to provide the Referred Person’s name and e-mail address. We will automatically send the Referred Person an e-mail inviting them to try our Service. We may also send a follow-up e-mail or e-mails, at our discretion. If a Referred Person no longer wants to receive communications from us, they can e-mail support@equilli.app with their request and we will discontinue further communications.

Customer Support:

We may collect Personal Information through your communications with our customer-support team.

Meta-data (information about your device, browser and app use):

Once you install the App, Equilli collects information about the use of the Services and information from the device you have Equilli installed on. For example:

User Feedback:

Requesters and Providers may be able to rate and review each other at the end of every task. Requesters and Providers may be able to see each other’s aggregate ratings before, during and after a task.


3. Why Equilli Collects Data

We may also use data to measure the usability and effectiveness of Equilli’s own marketing efforts on third party sites or platforms.

4. Sharing your Information


EQUILLI MAY DISCLOSE YOUR INFORMATION

The Services are based on a community of users publicly sharing information with Equilli and with other members of that community.

You can decide whether or not to provide personal information to the Services. However any personal information that you choose to share and submit for posting is neither private nor confidential and you should expect that it may be made public and known to others. Information you choose to provide may be posted along with your user name and other information including personal information you attached to your publicly available user profile.

We, at Equilli, take great measures to provide you with the best experience you can have while using the Services. However, Equilli has no control over the conduct of any user and disclaims all liability in this regard. Users are advised to carefully and thoroughly consider whether or not to make public or available any information and carefully examine all necessary details related to any communication with other users prior to any engagement or communication being made.

Participating in any user’s activities as a result, directly or indirectly, from using Equilli, is entirely at your own risk. Equilli is not a party to any agreement entered into between the users in any circumstances. The user has the sole and ultimate responsibility regarding compliance with all laws, regulations or any other duty. We do not accept any liability for any loss, damage, cost or expense that you may suffer or incur as a result of or in connection with your participation in any activity or event initiated, held or conducted by a user or a third party nor in connection to any agreement between the users or third parties, including any activity or event related in any way, directly or indirectly, the Services or the use thereof.

We may share your information:

Requesters and providers:

When a requester books a task or a provider is chosen to complete a task, we may share Personal Information, such as your name, phone number, email address, address, vehicle make, vehicle model, vehicle license plate or photographs with the other requester or provider. We also may share a users location and user feedback (as described above).

Marketing:

We do not rent, sell, or share Personal Information about you with other people or non-affiliated companies for their direct marketing purposes, unless we have your permission. We may share or allow access to data collected through tracking technologies to serve you personalized advertising content that may be relevant to your interests. Please see the Advertising section below to learn more.

As Required by Law and Similar Disclosures:

We may access, preserve, and disclose your Personal Information, other account information, and content if we believe doing so is required or appropriate to: comply with law enforcement requests and legal process, such as a court order or subpoena or to meet national security requirements; respond to your requests; or protect yours’, ours’ or others’ rights, property, or safety.

Information sharing consent:

By using the Equilli platform, you expressly consent and agree to accept and receive communications from us and other users, including via text (SMS) message, Apple IMessage, phone calls, emails and push notifications to the cellular telephone number you provided to us. Standard text messaging charges applied by your cell phone carrier will apply to text messages

sent. By consenting to being contacted, you understand and agree that you may receive communications, including marketing communications generated by automatic telephone dialing systems and/or which will deliver pre-recorded messages, sent by or on behalf of Equilli, its affiliated companies and/or Users, including but not limited to: operational communications concerning your account or use of the Equilli Platform or Services, updates concerning new and existing features on the Equilli Platform, communications concerning promotions run by us, and news concerning Equilli and industry developments. You acknowledge that you are not required to consent to receive promotional messages as a condition of using the Equilli Platform or the Services. If a contact number you have provided to us is no longer your number, you agree to notify us promptly that you can no longer be reached at that number. You represent that you have received, and are authorized to convey to us, the consent of any authorized users on your account to be contacted by us as described in this Section. You agree that all consents provided in this Section will survive cancellation of your account. You may opt-out of receiving promotional or marketing texts or calls from Equilli at any time. You may opt-out of receiving all text (SMS) messages from Equilli (including informational or transactional messages) by replying with the word “STOP” to a text message from us; however you acknowledge that opting out of receiving all texts may impact your use of the Equilli Platform or the Services. You also acknowledge that Equilli or its third party service providers may record customer service calls after notice to you and with your consent, in order to assist you when you contact our customer support services.

Equilli may use a service provider to mask your telephone number when you call or exchange text (SMS) messages or Apple Imessages with a Requester or Provider using a telephone number provided by Equilli. During this process, Equilli and its service provider will receive in real time and store call data, including the date and time of the call, text (SMS) message, Apple IMessage the parties’ phone numbers, and the content of the messages. You agree to the masking process described above and to Equilli’s use and disclosure of this call data for its legitimate business purposes.

The information described in this section may be transferred to, or processed and stored in, the United States and other countries, which may employ greater or less restrictive data protection laws. In all cases, we will take appropriate measures to protect your personal information in accordance with the policies described herein.


5. Personal Information Visibility


Public Areas:


Your profile on Equilli consists of information about you, and may include personal information, photographs, location, feedback/rating information, and other information, including your username (“Profile”). The information in your Profile may be visible to all Users and the general public subject to the privacy choices you make within your Profile. If you choose to request a task via Equilli, the contents of such listing will be publicly viewable.


6. Integration with Social Networks



You may choose to share information between your Equilli account and your social network account (such as Facebook). Through this option, you may choose to have personal information and other content about you available from social networks, transmitted and shared through the Services. Similarly, you may choose to have personal information and other content about you available from Equilli, including your location personal information, transmitted to and shared through your social network account.

By setting your Equilli Account to integrate with social networks, including by signing onto Equilli by using your social network account (such as your Facebook account and your Google account), you agree to share information (including personal information) between Equilli and such social networks, for the purposes provided under this Privacy Policy.

The social network’s use of information made available by Equilli is governed by that social network’s privacy policy and controlled by the social network, not by this Privacy Policy or Equilli.

When you connect to the social network account through the Services for the first time or otherwise make the Services interact with your social network account, you will be asked by the social network to permit the social network to share your personal information stored on such social network with Equilli. We collect your information from your social network account only in accordance with the permissions granted by you (such as your name, email address, list of friends, profile picture and other information available via the applicable social network).

You understand and agree that the Services may access, make available and store such information so that it is available on and through your Equilli Account, until your Equilli Account is deleted.

Please note that certain information which you have defined as private on your third party social network accounts may become public to other Equilli Users through the Services once you have allowed the social network to share such information with Equilli.

Logging in through Facebook:

In order to register to use Equilli, you might be asked to sign in using your Facebook login. By doing so, you are authorizing Equilli to collect, store, and use, in accordance with this Privacy Policy (and consistent with your privacy settings in Facebook), any and all information that you agreed that Facebook could provide to us through their application programming interface (“API”), including, without limitation, your Facebook username, Facebook profile picture, unique Facebook identifier and access token, email address, gender, birthday, current city, photos, personal description, friend list, and information about and photos of your Facebook friends who might be common Facebook friends with other Platform users. In addition, we may collect and store any personal information you provide while using our Platform, either directly or indirectly (e.g., by authorizing us access to the camera roll on your phone or other mobile device). This may include identifying information, such as your name, address, email address, and telephone number. All information we collect and/or receive under this section is collectively called “Personal Information.”


7. Integration with Other Third-party Services


Promotions and Co-Branded Services:

We or our advertisers and other business partners may conduct or sponsor special contests, sweepstakes, and other promotions (“Promotions”) that users may enter, register for or otherwise participate in through the Service. Certain of these Promotions may be co-branded with one of our advertisers, business partners, charities, sponsors or other third parties (“Third-Party Partners”). Such co-branded services will identify the Third-Party Partner. In these instances, the Third-Party Partner may collect your Personal Information directly on its website or another online service may collect your Personal Information and share it with us and/or the Third-Party Partner. If you enter a Promotion, your Personal Information may be disclosed to Third-Party Partners or the public in connection with the administration of such Promotion, including, in connection with winner selection, prize fulfillment, and publication of a list of winners, as required by law or permitted by the Promotion’s rules.

Google Analytics:

We use Google Analytics, a web analytics service. Google Analytics uses cookies to help Equilli analyze how visitors use the Site. The information generated by the cookie about your use of the Site and Equilli (including your IP address) will be transmitted to and stored by a Google server in the United States. Google uses this information for the purpose of evaluating your use of the Site, compiling reports on Site activity for Site operators, and providing Site operators with other services relating to Site activity and internet usage. You can prevent the storage of data relating to your use of the Site and created via the cookie (including your IP address) by Google, as well as the processing of this data by Google, by downloading and installing the browser plug-in available at the following link: https://tools.google.com/dlpage/gaoptout?hl=en


8. Controlling your Personal Information


Your choices for limited use and disclosure of your data:

You control your account information and settings. You may update your account information and email-communication preferences at any time by logging into the app and changing your settings under Edit Profile.

Communications:

You can stop receiving promotional e-mail communications from us by clicking on the “unsubscribe link” provided in such communications. We make every effort to promptly process all unsubscribe requests. You may not opt-out of Service-related communications (e.g., account verification, texts informing you of where your vehicle is located and the status of your live rides, receipts, reminders, changes/updates to features of the Service, technical and security notices, communications from other users).

Accessing, updating, or deleting your information:

If you would like to access, update or correct any information that you have provided to us through your use of the Service or otherwise, or if you would like to delete your personal information maintained by Equilli, or if you have suggestions for improving this Privacy Policy, please send an email to support@equilli.app. Upon request, we will take reasonable steps to correct, update, amend or delete your personal information, though we may not be able to permanently delete your personal information in all instances, such as when the information has been shared with third parties.

You have the right under certain circumstances:

Where the processing of your personal information by us is based on consent, you have the right to withdraw that consent without detriment at any time. You can also change your marketing preferences at any time as described in the Choice/ Opt-Out section above.


9. How Equilli Retains the Data we Collect


We may retain your information for as long as your account is active and for up to three years after you close your account or it becomes inactive, in accordance with our data retention policy. In certain circumstances, we may retain your information for longer periods of time in order to provide you with services, comply with our legal obligations, resolve disputes and enforce our agreements, in accordance with our data retention policy.


10. How Does Equilli Use Aggregated Information


We may aggregate and/or de-identify information collected through the Platform. We may use de-identified or aggregated data for any purpose, including without limitation for research and marketing purposes and may also share such data with any third parties, including without limitation, advertisers, promotional partners, sponsors, event promoters, and/or others.

11. Cookies


Cookies, Automatic Data Collection, and Related Technologies:

The Service and our third party partners collect and store information that is generated automatically as you use it, including your preferences and anonymous usage statistics. When you visit the Service, we and our third-party service providers receive and record information on our server logs from your browser, including your unique device ID, IP address, and from cookies and similar technology. Cookies are small text files placed in visitors’ computer browsers to store their preferences. We may use information collected through these tracking technologies to remember information so that you won’t have to re-enter it on subsequent visits, to provide and monitor the effectiveness of the Service, to provide custom, personalized content including targeted advertising, to automatically update the Service on your mobile devices and for other purposes. Most browsers allow you to block and delete cookies, though depending on your mobile device you may not be able to delete tracking technologies from your device. Deleting or blocking cookies and other tracking technology may cause the Service to not work properly. Although we do our best to honor the privacy preferences of our members, we are not able to respond to Do Not Track signals from your browser at this time. Please see the Advertising section below to learn more about how tracking technologies may be used to serve advertising that is relevant to your interests.

By using the Service, you are authorizing us to gather, parse, and retain data related to the provision of the Service.


12. Advertising


We may permit third party online advertising networks to collect information about your use of our website over time so that they may play or display ads that may be relevant to your interests on our Service as well as on other websites or apps. Typically, the information we share is provided through cookies or similar tracking technologies, which recognize the device you are using and collect information, including click stream information, browser type, time and date you visited the site, and other information. Please refer to your browser’s or mobile device’s technical information for instructions on how to delete and disable cookies, and other tracking/recording tools. Note that disabling cookies may disable many features available through the Service. 13. Information Security


Security of your information:

We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure.

By using the Service or providing Personal Information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Service. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the Service or sending an email to you. You may have a legal right to receive this notice in writing. To receive free written notice of a security breach (or to withdraw your consent from receiving electronic notice), please notify us at support@equilli.app.

14. Compliance & Cooperation with Regulators


Children’s privacy:

We do not knowingly collect information from children under 13 and we do not want it. We will take steps to delete it if we learn we have collected it.

No part of our Service is directed towards children under the age of 13 and we do not knowingly collect, maintain, or use Personal Information from children under the age of 13. If you learn that your child has provided us with Personal Information without your consent, you may alert us at support@equilli.app. If we learn that we have collected any Personal Information from children under 13, we will promptly take steps to delete such information and terminate the child’s account, in compliance with the Children’s Online Privacy Protection Act (COPPA).

International users:

By using the Service, you will transfer data to the United States.

By choosing to visit the Service or otherwise provide information to us, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the law of the state of New York and the adjudication of any disputes arising in connection with Equilli or the Service will be in accordance with the Terms and Conditions.

If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your information to the United States and processing globally. By providing your information, you consent to any transfer and processing in accordance with this Policy.

EU users and our lawful bases for using your data:

Data protection law in Europe contains a number of "lawful bases," which are legal justifications for allowing organisations like us to have your personal information in the first place. We have been careful to ensure we have a lawful basis for using all EU user data. Our lawful bases include:

California Residents:

Under California Civil Code Section 1798.83, California residents who have an established business relationship with Equilli may choose to opt out of our sharing your Personal Information with third parties for direct marketing purposes. If you are a California resident and (1) you wish to opt out; or (2) you wish to request certain information regarding our disclosure of your Personal Information to third parties for the direct marketing purposes, please send an e-mail to support@equilli.app with “Privacy Policy” in the subject line.


15. Changes to this Privacy Policy

We may revise this Privacy Policy, so please review it periodically.

Posting of Revised Privacy Policy:

We will post any adjustments to the Privacy Policy on the Service, and the revised version will be effective when it is posted. If you are concerned about how your information is used, you should read this Privacy Policy periodically.

New Uses of Personal Information:

From time to time, we may desire to use Personal Information for uses not previously disclosed in our Privacy Policy. If our practices change regarding previously collected Personal Information in a way that would be materially less restrictive than stated in the version of this Privacy Policy in effect at the time we collected the information, we will make reasonable efforts to provide notice and obtain consent to any such uses as may be required by law.
